Can I press charges against credit card fraud culprit?
benandrew1970 asked:
I opened my credit card statement and discovered a $1,500 charge I didn’t make. I called the credit card company and they investigated. They found out it was someone who stole my # and charged their monthly child support with it. When they link the child with the responsible parent, can I press charges for fraud and attempted theft?

Yes you can. That person will be arrested for credit card fraud.

Typically the Credit Card company does – you are only liable for up to $50

it’s not attempted if they did it.
you call your local police and let them know someone is using your identity and credit card info to make payments/purchases.
they will either write the fraud report or possibly direct you to the state police to do it. either way you get a report.
make sure before you call the police you have all your paperwork handy.
the police will tell you what charges can be pressed upon the suspect.
don’t call 911 for this either. there are non emergency #s for your police in the phone book

Yes, there are state and federal crimes that have been committed in a credit card fraud, including fraud, theft, forgery, and unlawful use of a banking token (the card itself). The fact that you DON’T have to pay the fraudulent charge has nothing to do with the criminal, as it is between you and the bank issuing the card (they have insurance for this). What if you had not spotted the charges in time? The crime had already been committed, and the local D.A. or US Attorney may take the case to prosecute (perhaps as part of a larger scheme), if they have the time and budget for this.
